First you "eat" the milk foam with the spoon, after that, the top of the glass will be well temperatured, so you can enjoy your coffee...
And: in Germany, you usually can't sue any company because you burned yourself with hot coffee they delivered to you. You wanted hot coffee, you got it. Your an adult, so you should know that hot coffee possibly hurts.
